In accordance with the provisions of Article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (here in after, «LSSI»), we inform you that the website peopleofthe.cloud is operated by ADENMAGA People of the Cloud S.L, with C.I.F B16949125, whose registered office is located at Calle de Serrano, 8, 28001 Madrid, Madrid, and registered in the Commercial Registry of Madrid in Volume 42531, Folio: 96, Section 8, Sheet M-752532, 1st Registration.

The company PeopleoftheCloud, S.L. may here in after be referred to as PeopleoftheCloud.

2.- Use of the Portal

This Legal Notice regulates the access, navigation, and use of the website PeopleoftheCloud.io as well as all its subdomains *.PeopleoftheCloud.io and *.PeopleoftheCloud.app or other online tools with the PeopleoftheCloud brand such as GoogleForms (https://docs.google.com) or TypeForm, all referred to as ‘Websites’.

This Legal Notice (here in after, «Legal Notice»), together with the Terms and Conditions of Use (here in after, «Terms and Conditions»), establish the conditions that regulate the use of the services that PeopleoftheCloud makes available to Internet users through the Website. The aspects related to the processing of Users’ personal data due to the use of the Website are regulated in the Privacy Policy.

Thus, access and use of its ‘Websites’ imply that the user (here in after, the «User») fully accepts and agrees to comply with this Legal Notice, the Privacy Policy, the Terms and Conditions, as well as the instructions or recommendations indicated in each specific case.

PeopleoftheCloud reserves the right to make, at any time and without prior notice, modifications and updates to its ‘Websites’ and their contents, configuration, and presentation, including this Legal Notice and the Terms and Conditions, so we recommend reading them before each access and navigation through the Portal.

The User agrees not to use its ‘Websites’ for fraudulent purposes, as well as not to engage in any conduct that could damage the image, interests, and rights of PeopleoftheCloud or third parties, committing to use the Portal, services, and contents included therein diligently, correctly, and lawfully.

In particular, the User agrees to refrain from: removing, circumventing, or manipulating the «copyright» and other identifying data of the rights of their holders incorporated into the contents of their ‘Websites’, as well as the technical protection devices, or any information mechanisms that may be included in such contents. Likewise, the User agrees not to perform any act aimed at damaging, disabling, or overloading its ‘Websites’, or that would prevent, in any way, the normal use and operation thereof.

In case of non-compliance with this Legal Notice and/or the Terms and Conditions, or if PeopleoftheCloud reasonably suspects that they are being breached, PeopleoftheCloud reserves the right to limit, suspend or terminate your access to its ‘Websites’, adopting any technical measures necessary for this purpose. Likewise, PeopleoftheCloud reserves the right to decide, at any time, on the continuity of the services it provides through the Portal.

The assignment in favor of PeopleoftheCloud is made for the entire world, for the entire duration of the rights, and includes the power to assign to third parties.

PeopleoftheCloud reserves the right to decide on the disclosure or publication of the Generated Contents.

3.- Purpose and Conditions of Use

PeopleoftheCloud informs you that access, navigation, and use of this website are subject to these terms of use, recommending that you read them carefully as you must give your express and unequivocal consent to accept such conditions.

The user agrees to use our website in accordance with the law, this legal notice, regulations, and instructions brought to their attention, as well as morality, generally accepted good customs, and public order.

PeopleoftheCloud presents itself in the market, through its ‘Websites’ and Social Networks, as an investment vehicle and independent technology consultancy that focuses on new projects and start-ups, providing investment, resources, and knowledge to companies.

PeopleoftheCloud will share the information provided through the website and digital media with employees and investors to evaluate and assess the requested investment or the project to be developed.

– Service cost:

The service offered by PeopleoftheCloud, the investment conditions, the project development conditions, the return on the same, as well as complementary services, are agreed upon through a private contract with both investors and participating companies.

– Users:

Access and/or use of the PeopleoftheCloud ‘Websites’ as well as any private web area or mobile application, grants you the status of User, and you accept, from such access and/or use, this Legal Notice and Terms of Conditions.

Responsibility for the data provided:

The user will be responsible for the data provided in the questionnaires or mobile applications or by phone in a recorded call, on which the evaluation of the agreed investment will be based. If the user uses the service provided by PeopleoftheCloud with data that is not theirs, they will be responsible for the consequences of not having the corresponding authorization from the owner of such data.

PeopleoftheCloud will not be responsible when the user has not provided truthful or accurate data.

The personal data provided by users are intended to carry out both the receipt of investment and the evaluation of investments.

PeopleoftheCloud only transfers information to private investors or investment companies to evaluate the projects where to invest, having signed a confidentiality agreement with all parties. In no case is the transfer of such data carried out for purposes other than those stated. All information in this regard is exposed in the «Privacy Policy», whose reading is necessary by the user, as well as the user must give their consent for it. In any case, the actions of PeopleoftheCloud are in accordance with the provisions of Law 15/1999, of December 13, on the Protection of Personal Data, Regulation (EU) 2016/679 (GDPR), and other regulatory or regulatory provisions that develop or apply.

4.- Responsibility of PeopleoftheCloud

The user does not contract any service or product with PeopleoftheCloud, so PeopleoftheCloud will not be responsible for the conditions and terms of the contracts that the user signs with other companies derived from the relationship with PeopleoftheCloud. PeopleoftheCloud is not responsible for possible contingencies or damages that may arise in the relationship between the user and other companies during the term of the contract, and even when it has already ended.

PeopleoftheCloud will not be responsible for links to other content or third-party information that allows users to access from the PeopleoftheCloud website when they are illegal or harm the property or rights of a third party subject to compensation. However, once it becomes aware of this, PeopleoftheCloud will proceed with due diligence to remove or disable the link to the corresponding content or information.

The websites and content from which the user can access from the PeopleoftheCloud ‘Websites’ are owned and managed by entities unrelated to PeopleoftheCloud, so PeopleoftheCloud will not be responsible for their operation, content, or the products or services they offer. However, once it becomes aware that its content is illegal or harms the property or rights of a third party subject to compensation, PeopleoftheCloud will proceed with due diligence to remove or disable the direct link from PeopleoftheCloud to that website.

Users are obliged and committed to using the PeopleoftheCloud ‘Websites’ correctly, lawfully, and diligently, regarding the services or products offered therein, and especially not to make any use of their ‘Websites’ that may be contrary to the purposes of PeopleoftheCloud or the law.

PeopleoftheCloud reserves the right not to provide its services to any user who makes fraudulent use of its ‘Websites’ or who breaches or contravenes any of the conditions set out in «Terms and Conditions», and in such case, PeopleoftheCloud may deny access to the PeopleoftheCloud ‘Websites’.

PeopleoftheCloud will not be responsible for damages of any kind that users suffer as a result of non-compliance with the provisions of «Terms and Conditions» and «Privacy Policy», as well as any other content provided by PeopleoftheCloud in its ‘PeopleoftheCloud Applications’ or any other obligations required by law.

5.- Complaints and Claims

The satisfaction of PeopleoftheCloud users with the service provided through the ‘PeopleoftheCloud Applications’ is PeopleoftheCloud’s main concern. To this end, it makes available to users, in case they want to file a complaint or claim, as well as when they have doubts during their use, regarding the services provided by tQuity, the email address: support@tquity.com.

6.- Industrial and Intellectual Property

All industrial or intellectual property rights over the ‘PeopleoftheCloud Websites’ and the contents and information included therein are legally reserved to PeopleoftheCloud, S.L., and protected by Intellectual and Industrial Property regulations, particularly by RDL 1/96 approving the Revised Text of the Intellectual Property Law and by the Trademark Law 17/2001.

Access to the ‘PeopleoftheCloud Websites’ or their use by users cannot be considered in any way as granting any right, authorization, or license of any kind regarding such rights, contents, or information. The reproduction, transformation, distribution, public communication, making available, extraction, reuse, forwarding, or use of any nature, by any means or procedure, of any of such rights, is expressly prohibited unless express and written authorization is obtained from TECH4EQUITY, S.L.

7.- Commercial Use

The ‘PeopleoftheCloud Websites’ are not for commercial use. Unauthorized commercial use or mass use may slow down the service speed that PeopleoftheCloud provides to its users.

PeopleoftheCloud monitors the use of its service and if it detects commercial or mass use before presenting the comparison results, PeopleoftheCloud will abort it. In any case, PeopleoftheCloud reserves actions against those who try to use its service unauthorized, to prevent service interruption to genuine users and to compensate for any loss suffered.

8.- Copyright

The copyright of the material contained in the ‘PeopleoftheCloud Websites’ belongs to PeopleoftheCloud, S.L. Any individual, acting as a private person, may print a copy of any part of this material for their own personal use, subject to the following conditions:

The material cannot be used for commercial purposes. The copy must retain any copyright or other notices contained in the original material.

The technology and processes used or described on the PeopleoftheCloud, S.L. website may be subject to other intellectual property rights reserved to PeopleoftheCloud, S.L.

The images displayed on the PeopleoftheCloud, S.L. website are protected and cannot be reproduced or displayed in any way without the written permission of their respective owners.

No logo or trademark appearing on this site may be printed or copied, except as part of the text of which it forms part.

9.- Limitation of Liability

This website does not offer any kind of warranty, either express or implied, PeopleoftheCloud does not guarantee that the ‘PeopleoftheCloud Websites’ will be available at all times. It is also not responsible for direct or indirect damages arising from the use of the ‘PeopleoftheCloud Websites’, including damage to computer systems that may be caused to the user or third parties, nor does it guarantee the absence of viruses or other harmful elements.

10.- Personal Data Protection Policy

PeopleoftheCloud has defined its data protection policy in accordance with the provisions of Organic Law 15/99 on the Protection of Personal Data and RD 1720/2007 of December 21, which approves the Regulation for the development of the LOPD, regarding the data that you freely and voluntarily provide through our website. It has also adopted the technical and organizational security measures required by current legislation on personal data protection (new GDPR regulations applicable from May 25, 2018, which the Company decided to adopt from the beginning).

PeopleoftheCloud reserves the right to modify the contents of this website at any time, without this implying any harm to the user and respecting, where appropriate, the general contracting conditions that are in force at any given time.

11.- Jurisdiction

The relationships established between PeopleoftheCloud and the User will be governed by the provisions of the current regulations regarding applicable legislation and competent jurisdiction. However, for cases where the regulations provide the possibility for the parties to submit to a jurisdiction, PeopleoftheCloud and the User, expressly waiving any other jurisdiction that may correspond to them, submit to the Courts and Tribunals of the city of Madrid.
